These Terms & Conditions apply to services provided by Groundbreak Earthworks, including excavation, earthworks, drainage, trenching, drilling, retaining, demolition, site preparation, truck hire, cartage, tipping and associated contracting services.
By accepting a quotation or engaging our services, customers agree to the applicable terms outlined below, subject to any separately agreed written conditions and applicable New Zealand law.
1. Quotations & Pricing
All quotations are based on the information available at the time of assessment. Additional work, unexpected ground conditions, unsuitable materials, underground obstructions or changes to the original scope may result in additional charges. Unless otherwise stated, quoted prices exclude GST.
2. Payment Terms
Invoices are payable within 7 days of the invoice date, unless otherwise agreed in writing. Groundbreak Earthworks reserves the right to suspend further work or services where payments become overdue, subject to applicable law and contractual obligations. Additional costs resulting from payment delays may be charged where agreed and legally permitted.
3. Site Access & Preparation
Customers must provide suitable and safe access for machinery, trucks and personnel.
Customers are responsible for identifying relevant property boundaries, access restrictions and known site hazards.
Delays caused by unsuitable access or inadequate site preparation may result in additional charges.
4. Underground Services
Customers must disclose all known underground services, including water, power, gas, telecommunications, drainage and sewer connections.
Groundbreak Earthworks will take reasonable precautions when excavating near underground services.
Where required, appropriate service plans, locating procedures and safe excavation methods must be arranged before work begins.
5. Ground Conditions & Excavation
Excavation pricing is based on reasonably anticipated ground conditions. Unexpected rock, buried concrete, contaminated material, groundwater, unstable ground or other unforeseen conditions may require additional equipment, labour or disposal. Any additional charges will be discussed with the customer where reasonably practicable.
6. Trucking, Cartage & Tipping Truck hire, cartage and tipping services are subject to site access, load restrictions, disposal requirements and availability. Customers must accurately describe materials requiring transport or disposal. Contaminated, hazardous or prohibited materials will not be accepted without prior written agreement and appropriate arrangements. Additional charges may apply for waiting time, rejected loads, unsuitable materials or unexpected disposal costs.
7. Machinery Hire & Subcontracting
Machinery and operator hire are subject to availability and agreed rates. Minimum hire periods, transport charges and additional equipment costs may apply where specified in the quotation or hire agreement. Groundbreak Earthworks may engage suitably qualified subcontractors to complete agreed services.
8. Delays & Weather Conditions
Work schedules may be affected by adverse weather, unsafe ground conditions, equipment breakdowns, material availability or circumstances beyond our reasonable control. Groundbreak Earthworks will make reasonable efforts to communicate significant delays and arrange suitable alternatives.
9. Changes & Cancellations
Customers should provide reasonable notice when cancelling or postponing scheduled work. Reasonable costs already incurred for equipment transport, materials, subcontractors or other agreed preparations may be charged where permitted by law. Changes to the agreed scope may affect pricing and completion dates.
10. Damage & Liability
Groundbreak Earthworks will exercise reasonable care and skill when carrying out services. Customers must disclose known hazards, concealed structures and relevant site information. Responsibility for damage or loss will be determined according to the circumstances, contractual obligations and applicable New Zealand law. Nothing in these terms excludes or limits rights or remedies that cannot lawfully be excluded, including applicable rights under the Consumer Guarantees Act 1993.
11. Health & Safety
Groundbreak Earthworks is committed to maintaining safe working practices in accordance with applicable New Zealand health and safety legislation. Customers, contractors and visitors must follow reasonable site safety requirements. Work may be suspended where conditions present an unacceptable safety risk.
